Cllr K Smith declared an interest in the above agenda item and took no part in the discussion.
The Chairman informed members that he had received information from a Maldon District Council Planning Officer that several letters of objection had been received regarding the above application and that the deadline date for comments had been extended as the applicants had not notified other tenants at Hill House Park in accordance with their lease. Members recalled that the Town Council had previously had no objection to this application but the Chairman reported that the plans were inaccurate and the application should be considered again. The Chairman also said that approval had not been sought from the leaseholders within the area who had not been notified.

The member of the public stated that two chimneys had been omitted from the plan, they were shown as drains, which would need to be raised and would be unsightly from Market Hill and possibly the by-pass also there was no reference to the relocation of the water tanks.

TOWN AND COUNTRY PLANNING ACT 1990
PROPOSED STOPPING UP OF HIGHWAY - LAND ADJOINING 7 MASEFIELD ROAD, MALDON
Further to minute 221.b.8 of the Planning Committee meeting held on 14th April 2003, members received the following correspondence from The Planning Casework Team, Government Office for the East of England:
I refer to your letter of 18 September 2003 lodging an objection to the above mentioned proposal.
It is our practise in the first instance to refer any objection to the applicant for the Order in case they wish to discuss the matter with the objectors.
I have therefore sent a copy of your letter to Mr. Everitt, who applied for the Order, and who may be getting in touch with you.
A letter was circulated to members from Mr. Everitt which indicated that if the objection to the Stopping Up Order was not withdrawn it could involve a lengthy and costly Public Enquiry. He also felt that the Town Council were setting double standards regarding the proposed plan for the amenity area in Tennyson Road.
The Chairman informed members that as a result of discussions with Mr. and Mrs. Everitt he had ascertained that the land was owned by Mr. Everrit and that a 'License to Plant' had been issued by the Essex County Council in 1998. In the light of the new information members agreed that although it is Town Council policy to protect amenity areas, in this case it was felt that minute 21.b.8 of the Planning Committee meeting held on 14th April 2003 should be rescinded and the objection to the Stopping Up of Highway Land Order in respect of the area adjacent to 7 Masefield Road be withdrawn. It was also felt that Mr. Everitt should be informed that the proposals for the amenity area in Tennyson Road were at the request of the residents.
RECOMMENDED: that (a) minute 21.b.8 of the Planning Committee meeting held on 14th April 2003 be rescinded;
(b) a letter be forwarded to Go East and Mr. Everitt stating that in the light of additional information, the Town Council withdraws the objection to the Stopping Up of Highway Land Order in respect of land adjoining 7 Masefield Road.

A member of the public enquired why Councillors do not visit the planning application sites prior to meetings and was informed that often it is difficult as the applications are not received in the office until the day of the meeting.
