Minute 201 - Essex Minerals Local Plan Second Review - First Deposit
The Chairman said he had also referred to Danbury Aggregates who transport .4 million
tonnes of aggregate per year.
Minute 204 - Temporary Signals, Wantz Road/Mundon Road/Cross Road/Mill Road,
Maldon
The Chairman said that the minute was incorrect as Cllr Mrs Riesebeck was referring to
traffic lights which had been installed further up Wantz Road to assist with the
repairworks. Cllr Mrs Riesebeck replied that the minute as recorded was correct.
RESOLVED: that the minutes of the Planning Committee meeting held on 16th February 2004 were confirmed and signed as a true record.

It was felt that although this is a large prominent tree the work should be undertaken as the tree has in the past undermined the adjacent brick wall.
RESOLVED: that the Town Council has no objection to this application subject to the approval of the Tree Officer.

MALDON DISTRICT REPLACEMENT LOCAL PLAN
PUBLIC LOCAL INQUIRY
Further to minute 190 of the Planning Committee meeting held on 16th February 2004, members received the Maldon District Council responses to the following Town Council objections to the Draft Replacement Local Plan:
a. Reference - MDC/POL/BE24-27 - Telecommunication Development and Satellite Dishes
Reference - MDC/POL/T4 - Cycle Routes
Reference - MDC/POL/PU1A - Provision of Education Facilities
Reference - MDC/POL/T2 - Transport Infrastructure in New Developments
b. Members were informed that, the following responses to the Town Council's objections
to the Draft Replacement Local Plan had been received in the office but too late to be included on the agenda:

Reference - MDC/POL/PU - Miscellaneous Issues
Reference - MDC/POL/REC12a - Leisure and Civic Quarter, South East Maldon
Reference - MDC/POL/H4/SITE 5 - Housing Site 5, Princes Road, Maldon
Reference - MDC/POL/PU1 - Protection of Health Care Facilities
It was felt that the above responses, particularly the Leisure and Civic Quarter, South East Maldon and the Housing Site 5, Princes Road, Maldon required more time to read and in view of the fact that the deadline for comments was 12th March 2004 it was suggested that a Special meeting be held at 7pm prior to the Finance and General Purposes Committee meeting.
RECOMMENDED: that (a) the information be noted;
(b) the above Maldon District Council responses to the Town Councils comments regarding the Draft Replacement Local Plan be considered at a Special meeting to be held at 7pm prior to the Finance and General Purposes Committee meeting.

ROAD SAFETY WORKING PARTY
Members received the notes of the Road Safety Working Party meeting held on 16th February 2004.
Note 3.b. - Accident Statistics and Traffic Calming - Top End of High Street and Junction at Butt Lane
The Chairman referred to the second paragraph which made reference to a man up a ladder and said that since the meeting there had been a change in legislation affecting working height; the previous working height of 2 metres had been removed.
Note 3.c. Recommendation (i)
It was (amended at the Planning Committee meeting held on 15th March 2004 - min 224 refers) reported that the damaged bus sign in the location of the White Horse Public House had been repaired.
Note 3.c. Recommendation (ii)
Discussion ensued regarding the suggestion that there should be a 'no left turn' into Butt Lane from the High Street and in this respect it was felt that this should apply only to lorries over 3.5 tonnes.
Note 6
The Chairman reported that since the meeting he had ascertained that it was the second hump in White Horse Lane that leads to Edwards Walk.
Note 11.b.
Cllr Mrs Riesebeck reported that the burned dog foul bins along Footpath 1 - Fambridge Road to Safeway Store had been replaced with the addition of an extra bin.
RECOMMENDED: that (a) note 3(c)(ii) be amended to read 'if all else fails there should be a 'No Left Turn' into Butt Lane from the High Street for Lorries over 3.5 tonnes apart from access;
(b) in all other respects the notes be approved and adopted.

PUBLIC ENTERTAINMENT LICENCE - SPORTSMAN SNOOKER CLUB
Further to minute 193 of the Planning Committee meeting held on 2nd February 2004,
members received a response from the Licensing Officer, Maldon District Council regarding the above which stated that the application for a Public Entertainment Licence for the premises had been refused and that the applicant could appeal within 21 days of the hearing date to the Magistrates Court.
Cllr Mackenzie informed members that he had attended the hearing regarding the above application as a resident of Market Hill and reported that it had been refused on public order. He felt that it was a well conducted meeting and that the Police who were legally represented, had done an excellent job in their presentation. He also felt that the applicant had been given a fair chance if he had had a good case the application would have been granted.
Members felt that, if in the future there is a situation where the Town Council wishes to attend a hearing, a legal representative should be appointed.
RECOMMENDED: that the information be noted.

APPLICATION NUMBER: OUT/MAL/03/00432
Members received the Appeal Decision regarding the appeal by Miss J S Nash, in respect of the site at land at Dyers Road, Maldon from which it was noted that the appeal had been allowed and planning permission granted. Members recalled that the Town Council had objected to this application.
The Chairman suggested that members keep the above paperwork for reference when a full planning application is received.
