RESOLVED: that Cllr Prior be elected Chairman of the Planning Committee for the 2002/03 Municipal Year.

Cllr Mrs. Downes proposed and Cllr Mrs. Foster seconded that Cllr Mrs. Curtis be Vice Chairman of the Planning Committee for the Municipal year.
RESOLVED: that Cllr Mrs. Curtis be elected Vice Chairman of the Planning Committee for the 2002/03 Municipal Year.

APOLOGIES FOR ABSENCE
Apologies for absence were received from Cllrs P Rew (Deputy Mayor) and K Smith.
Cllr P Rew had indicated that due to the new Code of Conduct and the fact that he is a District Councillor, he felt he could not be a member of the Planning Committee as this could prevent him voting at District Council Planning Committee meetings. Cllr Roberts said that the same situation could apply to him and the Town Clerk confirmed she would clarify the matter with Simon Quelch, Maldon District Council and submit a response to the next meeting of the Planning Committee.

There is evidence of lifting of the block paving. It is only slight but obviously will get worse as time passes. Minor roots (25 mm diameter) could be removed without detriment but any larger roots could well endanger the tree. This is a major tree but it does not form part of the local treescape. It may well be that the ultimate solution is to remove the tree.
Recommended: No objection to the removal of minor roots but the future of the tree should be discussed with the District Council Officer.
RESOLVED: that the Town Council supports this application subject to the approval of the Tree Officer.

ESSEX ASSOCIATION OF LOCAL COUNCILS - PLANNING CONFERENCE
Members received information regarding a Planning Conference to be held on Saturday July 6th 2002, at Foakes Hall, Great Dunmow, Essex at a cost of £35.00 per delegate (2 places per council, further places allocated numbers permitting).
RECOMMENDED: that Cllr Prior attends the above Planning Conference and payment be forwarded to the EALC confirming a place.

BLACKWATER CONFERENCE 2002
Further to minute 210 of the Planning Committee meeting held on 7th May 2002 regarding the Blackwater Conference 2002, Cllr P Roberts requested that his report regarding the Conference be deferred to the next meeting of the Planning Committee.
RECOMMENDED: that Cllr Roberts reports on his attendance at the Blackwater Conference 2002 at the Planning Committee meeting to be held on Monday 10th June 2002.

CONSIDERATION AND DETERMINATION OF PLANNING APPLICATIONS
Members received information from Clive Tokley, Chief Planning and Development Services Officer, Maldon District Council regarding the consideration and determination of Planning Applications.
Members felt that the public should be made aware that they are welcome to attend meetings of the Town Council Planning Committee and express their views and comments. Further publicity should also be given to the fact that the public can view planning applications in the Town Hall Foyer on Thursday evenings and during the day on Fridays. Cllr Thain enquired if weekly lists are to be received by e-mail and the Town Clerk said that such a request would be made.
RECOMMENDED: that (a) a press release be issued informing members of the public that they are welcome to attend Town Council Planning Committee meetings and that planning applications are available for inspection in the Town Hall Foyer Thursday evenings and Fridays 9.00am - 4.00pm;
(b) a request be forwarded to Clive Tokley, Planning and Development Services Officer, Maldon District Council to receive weekly planning lists by e-mail.

PUBLIC SPEAKING AT MALDON DISTRICT COUNCIL MEETINGS
Further to minute 201 of the Planning Committee meeting held on the 15th April 2002, members received the following correspondence from Clive Tokley, Chief Planning and Development Services Officer, Maldon District Council regarding public speaking at meetings:
Thank you for your letter of 30 April. This Council's response to the Green Paper was to the effect that it is not for Central Government to determine how the business of District Councils is carried out. Whilst the Green Paper encourages Councils to allow the public to speak at meetings there is no requirement for this to happen and Maldon District Council does not allow public speaking at meetings.
Discussion ensued regarding the response from Mr. Tokley and it was
RECOMMENDED: that a letter be forwarded to Cllr Rodney Bass, Leader, Maldon District Council thanking the District Council for working to the spirit of the Green Paper!!

PROPOSED RESIDENTIAL DEVELOPMENT AT THE FORMER
DOVERCOURT MOTORS SITE, WEST SIDE OF SPITAL ROAD, MALDON
GREAT CRESTED
NEWT SURVEY REPORT
Members received the results, summary and conclusions
of the Great Crested Newt Survey at the Ware Pond. Members expressed
their concern regarding the result of the Great Crested Newt survey
and enquired if the survey had been carried out at the appropriate
time of the year and to request survey methods. Cllr Bannister enquired
if any details had been received regarding the location of the spring
water that feeds the Ware Pond. It was felt that further investigations
should be undertaken regarding the appropriate time of year for
such surveys and it was
RECOMMENDED: that a letter be forwarded
to the British Trust for Conservation Volunteers (BTCV) requesting
details of survey methods and timescales which should be adopted
in respect of a Great Crested newt survey; |

RED HORSE CHESTNUT - ST PETERS NURSING HOME, MALDON
Members were informed that notification had been received from the Maldon District Council that following an urgent visit, consent had been given to the removal of a Red Horse Chestnut due to the canker to the base of the tree and its dangerous condition.
There was a duty to plant a replacement tree under Part ll of the Planning (Listed Buildings and Conservation Areas) Act 1990 and it had been suggested that one Acer pseudoplatanus 'Brilliantissimum' be planted as a replacement.
Discussion ensued regarding the replacement tree and it was
RECOMMENDED: that a letter be forwarded to the Maldon District Council Officer enquiring if the tree could be replaced with a Red Horse Chestnut Tree.

TCA/MAL/02/00476 - 5 FAMBRIDGE ROAD
Further to minute 209.d.13 of the Planning Committee meeting held on 7th May 2002, members recalled that the Town Council objected to this application due to the trees being only 1.5 meters high and requested to see an arboricultural report. Members received the following correspondence from Lee Southwell, Tree Officer, Maldon District Council:
I would like to remind the Town Council that applications on trees within conservation areas are only a prior notification. A discussion to refuse the notification cannot be made the only cause of action subject to the tree having a high amenity value is to make a tree preservation order.
I have enclosed further information with regard to trees in conservation areas for your information.
With regard to the above notification it has been decided that a TPO will be served on the Holly and the Ash will be allowed to be felled due to it being so close to the property.
A Tree Preservation Order had subsequently been made on the Holly Tree, 5 Fambridge Road by the Maldon District Council on 17th May 2002. The Order became provisionally effective on the date it was made and remains so until confirmed or otherwise within the period of six months from that date.
RECOMMENDED: that the information be noted.

Members received a copy letter from Mr. B Lloyd, Royal Court, Wantz Road, Maldon regarding a request to the Highways Department for double and single yellow lines in Royal Court.
Discussion ensued during which members agreed that this was a dangerous area and it was
RECOMMENDED: that a letter be forwarded to Mr. S Broad, Transportation and Operational Services, Essex County Council supporting the request for yellow lines in Royal Court.

ORBIT - TRANSPORT SOLUTIONS AROUND LONDON:
CONSULTATION ON THE PROVISIONAL STRATEGIES
An invitation had been received to attend the Geographical Reference Groups consultation Meeting, the last in the series of Orbit project meetings was to be held on Tuesday 2nd July at the Mothers Union, Westminster.
RECOMMENDED: that the information be noted.

PROPOSED CONSTRUCTION OF NEW ENTRANCE GATEWAY TO GROUNDS, BEELEIGH ABBEY, ABBEY TURNING, BEELEIGH
APPLICATION REFERENCE FUL/MAL/02/0290
The following letter had been received from Kathryn Matveichuk, Development Control Officer, Maldon District Council:
In response to your councils concerns regarding the proposal, the applicant has agreed to amend the proposal to fit opening panels within the small wicket gate within the larger gateway to allow the public to see the Abbey. The applicant proposes that these panels will be kept open during the day but closed at night for security reasons.
The proposal is due to be considered at the Central Area Committee on 5 June 2002 and so I would be obliged to receive your Council's view on the amendment to the proposal prior to this date.
RECOMMENDED: that a letter be forwarded to Kathryn Matveichuk, Development Control Officer, Maldon District Council informing her that members of the Town Council Planning Committee object to the above application as the proposed entrance does not conform with the historic Abbey and obscures the view to the public.
